Minutes of the Meeting of the Board of Directors

Monday, June 20th, 2005
Middleton Public Library

Board Members Present: Chuck Nahn, Dave Halberslaben, Dave Kalshoven, Annette Plante-Hogoboom, Mandla Tshabalala

Board Members Absent: Ken Player

Meeting called to order at 6:35 P.M.

Special Guest
Sally Kefer of Friends of Pheasant Branch gave a brief description of efforts to purchase 19 acres of the Highland section of the conservancy (near the water tower). Their goal is to puchase land and turn it over to the city to be kept in conservation easement in perpetuity. They are halfway to raising the money needed to purchase of $3.1 million. This area is zoned high-density residential and would probably become condominiums if not conservancy. They need the money by November 1, 2005 in order to purchase the land.

Approval of May minutes-Kalshoven moved, Halberslaben seconded to approve minutes. Motion passed with Tschabalala abstention.

Committee Reports
    Safety Committee:
      Feedback on the special meeting pertaining to the trail, vegetation and water issues in the neighborhood - No feedback from neighborhood was reported. Not a lot of people in the neighborhood know about this.

    Finance Committee:
      Billing for the special meeting/proxy mailing. Cost concerns for 2 single sheets vs double sided sheet - Kalshoven said he will check billing to make sure we are not billed for extra mailings since some families received two notices.

      Past due collections for annual fees- 8 families are left which have not paid their 2005 annual fees. Kalshoven will be trying to contact these families.
    Communications Committee:
      Not represented, no report.
    Social Committee:
      Not represented, no report.
    Neighborhood Maintenance:
      Tree replacement project - One tree has been replaced on the berm near Redtail Pass and area cleaned up. Children are still pulling branches off (Parental control issue).

      2 dead bushes in front entrance south of Indigo - Dave will talk to Steve Bassett about replacement. We may not want to replace them with the same kind since they always die.

      Why is north side of front berm (north of Heron) not maintained?

      Landscaping around “Acker rock” at intersection of Indigo and Sandhill - Halberslaben will get bids to place 3 arbor vitae trees behind rock. Consideration of this at July BOD meeting.
    Architectural Control:
      Fences: A lengthy discussion on how to approach NNA members regarding neighborhood consensus and alteration of covenants took place. Nahn distributed a draft letter to be sent out to the neighborhood on both the fence and vegetation/trail issue. This is important because the ACC has recently received the first outdoor private pool submittal which requires a fence per city ordinance. Nahn will research the city ordinance to see how close to the pool and how high the fence must be. It was noted that pools are not prohibited according to neighborhood deed restrictions. However, there may be concerns about safety/aesthetics/maintenance/noise of the pool. Since this is the first private pool request in the neighborhood, the BOD needs to set up guidelines for pools so that they can be dealt with equitably for all of the neighbors in the future. After lengthy discussion, a motion was made by Tschabalala to review Nahn’s letter and act on it in the July meeting. Motion failed for lack of second. Plante-Hogoboom made a motion to send out the fence notification letter within 14 days of the June meeting (after BOD review and modification) but not the vegetation trails letter. Tschaballa seconded and motion passed with Nahn in opposition.

      Hilltop Cir. The meeting with both families to resolve tree height concerns has not yet occurred. Plante-Hogoboom will have a meeting with them soon.

      Neighborhood concerns regarding side yard placement of a play structure. Some people are contacting a former board member regarding this. She has been asked to redirect these individuals to contact an ACC member so that we can further investigate. No address for the subject property has been provided as of yet. Halberslaben will take care of.
New Business
    Trail and Vegetation proposal
      Discussion on how to inform NNA members of the potential plans and gather the neighborhood consensus.
Other Business
    Board Vacancy
      Presentation of Secretarial Candidates to the BOD - Not enough lot-owners were present to meet the 10% quorum of 28 lots. Ron Scheinen is interested in running for the vacant BOD seat. Attempt to elect new board member in July if we get enough people to make quorum.
